1. Introduction

GeoTech ("GeoTech", "we", "us", or "our") operates an online platform designed to connect users with businesses and service providers and to allow businesses and service providers to advertise their products and services.

Your use of GeoTech is subject to these Terms and applicable South African law.

2. Definitions

• GeoTech means the GeoTech platform and the business operating the website.
• Website means geo-technology.co.za and associated pages, services and functionality.
• User means any person who accesses or uses the Website.
• Registered User means a person who has created an account.
• Business means a business, professional, service provider, organisation, or other entity advertised on the Website.
• Listing means a business or service advertisement submitted to the Website.
• Listing Owner means the person or entity responsible for a Listing.
• Listing Plan means a paid or otherwise applicable advertising plan offered by GeoTech.
• Services means the advertising, directory, search, listing, account, payment, and related services provided by GeoTech.
• Content means text, photographs, logos, videos, documents, business information, contact details, descriptions, links, and other material submitted to or displayed on the Website.

3. About GeoTech

GeoTech provides an online platform for the advertising and discovery of businesses and service providers.

GeoTech may provide tools that allow businesses to:

• Create business listings.
• Advertise their businesses.
• Select listing categories.
• Provide business descriptions.
• Display contact information.
• Display business locations.
• Upload images and logos.
• Advertise services.
• Receive enquiries.
• Appear in search results.
• Purchase advertising or listing plans.

GeoTech is primarily a platform and advertising service. Unless expressly stated otherwise, GeoTech does not act as the employer, agent, representative, contractor, partner, or guarantor of any business listed on the Website.

4. Eligibility

You must provide accurate information when creating an account or submitting a Listing.

You may not use the Website if you are prohibited from doing so under applicable law.

If you create an account or submit a Listing on behalf of a business or organisation, you confirm that you are authorised to act on behalf of that business or organisation.

5. User Accounts

Certain features require you to create an account.

You are responsible for:

• Providing accurate registration information.
• Keeping your login details confidential.
• Maintaining the security of your password.
• Preventing unauthorised access to your account.
• Ensuring that information associated with your account remains accurate.

You must notify GeoTech if you reasonably believe that your account has been compromised or accessed without authorisation.

6. Business Listings

Users may submit business and service-provider Listings to GeoTech.

Listing Owners are responsible for ensuring that all information submitted is accurate, current, complete, lawful, and not misleading.

A Listing may include:

• Business name.
• Business description.
• Category.
• Location.
• Contact details.
• Website.
• Services.
• Business photographs.
• Logos.
• Social-media links.
• Operating information.

GeoTech may review Listings before publication and may refuse, edit, remove, suspend, or reject a Listing where reasonably necessary.

7. Accuracy of Business Information

GeoTech does not guarantee that information supplied by businesses is accurate, complete, current, or reliable.

GeoTech does not independently guarantee the existence, qualifications, quality, pricing, availability, legality, or claims of any business listed on the Website.

Users should independently verify important information before entering into a transaction with a business.

8. Business Verification

GeoTech may introduce verification features or verification requirements from time to time.

Unless a Listing is specifically identified as verified, users should not assume that GeoTech has independently verified the business, its qualifications, licences, certifications, ownership, or claims.

A verification process, where offered, does not constitute a guarantee or endorsement by GeoTech.

9. Listing Categories

GeoTech may organise Listings into categories including, but not limited to:

• Builders.
• Electricians.
• Plumbers.
• Architects.
• Lawyers.
• More.
• Services.

GeoTech may add, remove, rename, combine, or reorganise categories where reasonably necessary to improve the Website.

10. Listing Plans and Pricing

GeoTech may offer different Listing Plans at different prices and durations.

The applicable price and plan details will be displayed during the purchasing process.

Listing Plans may differ in features, visibility, duration, placement, or other benefits.

GeoTech may change its pricing or introduce new Listing Plans from time to time. Changes generally apply to future purchases and do not retrospectively change the price of a completed purchase unless otherwise permitted by law.

11. Listing Duration

A Listing may have a defined active period depending on the Listing Plan purchased.

Certain Listings may be designated as Never Expires where this feature is available and applicable to the Listing.

A "Never Expires" Listing does not necessarily mean that the Listing will remain permanently available regardless of circumstances.

GeoTech may suspend or remove a Listing if the Listing violates these Terms, contains unlawful content, contains materially false information, is associated with fraud or abuse, creates a legal or security risk, or where the Website or service is discontinued.

12. Listing Publication

Submitting a Listing does not guarantee immediate publication.

GeoTech may review Listings before publication.

A Listing may be delayed, rejected, modified, suspended, or removed where reasonably necessary.

13. Listing Content

By submitting Content to GeoTech, you confirm that you have the necessary rights to use that Content and that it does not unlawfully infringe another person's rights.

You are responsible for ensuring that Content is lawful, accurate, and not misleading.

14. Licence to Display Listing Content

By submitting Content to GeoTech for publication, you grant GeoTech a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, format, modify for technical or presentation purposes, and distribute that Content as reasonably necessary to operate and promote the Website.

You retain ownership of your original Content.

15. Prohibited Listings and Content

You may not submit Content that:

• Is unlawful.
• Is fraudulent.
• Is deliberately misleading.
• Infringes copyright.
• Infringes trademarks.
• Contains malware or malicious code.
• Promotes illegal activity.
• Impersonates another person or business.
• Contains false business credentials.
• Contains stolen personal information.
• Harasses or threatens another person.
• Is defamatory or unlawfully discriminatory.
• Promotes scams or fraudulent schemes.
• Misrepresents products or services.
• Violates applicable law.
• Attempts to manipulate search results or Website functionality.

GeoTech may remove prohibited Content without prior notice where reasonably necessary.

16. Public Information

Business Listings are intended to be publicly accessible.

Information included in a Listing may be viewed by Website visitors, registered users, potential customers, search engines, and other third parties.

17. Payments

Where a Listing Plan or other service requires payment, payment must be completed through the payment method made available during checkout.

GeoTech may use third-party payment providers, including PayFast.

A Listing Plan will only be activated once the applicable payment has been successfully confirmed, unless otherwise stated.

18. Payment Confirmation

A payment confirmation or transaction reference does not necessarily mean that a Listing has been approved.

GeoTech may still review a Listing after payment.

19. Refunds and Cancellations

Refunds will be handled in accordance with applicable law and GeoTech's applicable refund policy.

Where a refund is legally required, GeoTech will process the refund in accordance with the applicable legal requirements.

Where a Listing has already been published or a service has already commenced, the availability of a refund may be affected by the nature and extent of the service already provided and applicable consumer-protection law.

20. Pricing Errors

GeoTech attempts to ensure that pricing information displayed on the Website is accurate.

If a material pricing error occurs, GeoTech may take reasonable steps to correct the error and, where required by law, provide appropriate options regarding an affected transaction.

21. Communication

GeoTech may communicate with users by email or through the Website regarding:

• Account activity.
• Listing activity.
• Payments.
• Listing approvals.
• Listing expiry.
• Security.
• Password resets.
• Important service changes.
• Customer support.
• Other service-related matters.

22. Contact Between Users and Businesses

GeoTech may provide contact information, enquiry functionality, or other tools allowing users to communicate with businesses.

GeoTech does not guarantee that a business will respond, remain available, or provide accurate information.

Transactions entered into directly between users and businesses are generally between those parties.

23. GeoTech Is Not the Service Provider

Unless expressly stated otherwise, GeoTech does not provide the services advertised by independent businesses on the Website.

If a user contacts a plumber, builder, architect, lawyer, electrician, or other service provider through information found on GeoTech, the actual service agreement is between the user and that service provider.

GeoTech is not responsible for the quality of the service, conduct of the service provider, pricing, delays, damage, incomplete work, or disputes between the parties.

Users should conduct their own due diligence before engaging a business.

24. Reviews and User Feedback

If GeoTech introduces reviews, ratings, comments, or feedback functionality, users must provide honest and lawful feedback.

Users may not submit fake reviews, manipulate ratings, threaten businesses with negative reviews, or otherwise misuse review functionality.

GeoTech may remove reviews or feedback that violate these Terms.

25. Intellectual Property

The Website and its original content, design, branding, graphics, layout, software, functionality, and other materials are owned by or licensed to GeoTech unless otherwise stated.

You may not reproduce, copy, modify, distribute, sell, commercially exploit, or create derivative works from GeoTech's proprietary materials without appropriate permission.

26. GeoTech Name and Branding

You may not use the GeoTech name, logo, branding, or other identifying material in a way that suggests endorsement, sponsorship, partnership, affiliation, or ownership unless GeoTech has expressly authorised that use.

27. Website Availability

GeoTech aims to keep the Website available and functional but does not guarantee uninterrupted availability.

The Website may occasionally be unavailable because of maintenance, updates, technical problems, hosting problems, security incidents, Internet outages, third-party service failures, or circumstances outside GeoTech's reasonable control.

Third-party services may have their own terms and privacy policies.

29. Google Maps

GeoTech may use Google Maps and related Google services to provide location functionality.

30. Account Suspension and Termination

GeoTech may suspend or terminate an account where reasonably necessary if:

• The user violates these Terms.
• The user engages in fraudulent activity.

• The user repeatedly submits prohibited Content.
• The account presents a significant risk to GeoTech or other users.

31. Removal of Listings

GeoTech may remove or suspend a Listing if it violates these Terms, contains materially false information, is fraudulent, contains unlawful Content, infringes another person's rights, or creates a security or legal risk.

Removal of a Listing does not necessarily entitle the Listing Owner to a refund, particularly where the Listing violated these Terms or applicable law.

Any legally required refund rights remain unaffected.

32. User Responsibility

You agree not to:

• Attempt to gain unauthorised access.
• Interfere with Website functionality.
• Upload malicious software.
• Scrape or harvest information unlawfully.
• Circumvent Website security.
• Create fraudulent accounts.
• Manipulate Listings.
• Abuse payment systems.
• Attempt to disrupt the Website.
• Use GeoTech for unlawful purposes.

33. Privacy

GeoTech processes personal information in accordance with its Privacy Policy.

34. Disclaimer

To the extent permitted by law, GeoTech provides the Website and platform on an "as available" basis.

We do not guarantee that the Website will always be available, Listings will receive enquiries, a Listing will result in business, businesses will provide satisfactory services, information supplied by users will always be accurate, search results will always be complete, or third-party services will always function.

35. Limitation of Liability

To the maximum extent permitted by applicable law, GeoTech will not be responsible for indirect, incidental, special, or consequential losses arising from:

• Use of the Website.
• Inability to use the Website.
• Reliance on a business Listing.
• Transactions between users and businesses.
• Incorrect information supplied by users.
• Third-party services.
• Loss of business or revenue.
• Loss of data.
• Unauthorised access resulting from circumstances outside GeoTech's reasonable control.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

36. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims, liabilities, or reasonable costs arising from your unlawful use of the Website, your breach of these Terms, or Content you submit that infringes another person's rights.

This provision does not require you to indemnify GeoTech for losses caused by GeoTech's own unlawful conduct.

37. Complaints and Disputes

If you have a complaint about GeoTech, you should first contact us so that we have an opportunity to investigate and resolve the matter.

Nothing in these Terms prevents a consumer from exercising any statutory right or remedy available under applicable South African law.

38. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute concerning these Terms or the use of the Website will be dealt with in accordance with applicable South African law.

Nothing in this clause is intended to deprive a consumer of a mandatory legal right or forum available under applicable law.

39. Changes to These Terms

GeoTech may update these Terms from time to time.

Changes may reflect:

• Changes to Listing Plans.
• Changes to payment methods.
• Changes to applicable law.
• Changes to business practices.
• Security or operational requirements.

40. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or amended to the extent necessary to make it lawful where possible.

The remaining provisions will continue to apply to the extent permitted by law.

41. Entire Agreement

These Terms, together with the Privacy Policy, Checkout Privacy Policy, applicable Listing Plan information, and other policies expressly incorporated into these Terms, form the agreement governing your use of the applicable GeoTech services.
